ARTICLE 3 - PRODUCT AVAILABILITY AND ORDER CONFIRMATION



3.1 It is your responsibility to check during the order process, item by item, that the number and price have been taken into account in the order form.


3.2. When a Product is no longer available, On The Wild Side will inform you by email of this unavailability and will propose modalities in accordance with the article "Delivery".

ARTICLE 4 - PAYMENT



4.1. All orders must be paid in Euros on our secure transaction platforms PAYPAL or STRIPE. On The Wild Side will accept your online payment made with one of the following payment methods: Visa, MasterCard, American Express or Paypal. Your payment is encrypted and secured by STRIPE or Paypal. By communicating your credit card information, you authorize On The Wild Side to debit your credit card for the amount corresponding to the price of your order.


4.2. For a total amount exceeding 800 Euros, additional information may be requested.


4.3. You confirm that you are the holder of the debited bank card and that the name appearing on the bank card is indeed yours.


4.4. In the absence of payment of the full price of the order, On The Wild Side reserves the right to cancel the order without delay. It will be your responsibility to place a new order using a valid means of payment.


4.5. The Products remain the property of On The Wild Side until full payment has been received. 


4.6. You are solely responsible for any telecommunication costs incurred in accessing the Site.

ARTICLE 5 - DELIVERY



5.1 It is Your responsibility to ensure the accuracy of Your contact details when placing Your order: name, complete delivery/billing address, email address and telephone number. Delivery will be made to the delivery address indicated by You on the order form.


5.2 On The Wild Side delivers to all EU countries, the United Kingdom of Great Britain and Northern Ireland, Norway, Switzerland, the USA, Canada, South America, Russia, Japan, Singapore, South Korea, Taiwan and the Middle East. 

Delivery costs depend on the place and method of delivery chosen by You and are calculated on the total amount of the order. They will be indicated to You at the end of the order process before You confirm the order. 

After confirmation of the order and validation of the payment by On The Wild Side, the Products will be delivered according to the means chosen among those proposed during the ordering process.


5.3. We do our utmost to ensure that delivery takes place as quickly as possible, within 30 days at the latest. In the event of difficulties, we will keep You informed by e-mail. 

The delivery date is determined by the sum of the following elements: the successful receipt of your payment, the preparation of your order, the collection of the parcel(s) by the carrier and the delivery time of your parcel by the carrier according to the delivery method chosen by you on the Site.


5.4. When the parcel is dispatched, we send you the corresponding tracking number by e-mail. You can track your parcel from the moment it leaves our premises until it arrives, by entering its tracking number on the carrier's website.


5.5. Customs duties and other taxes due in the country of arrival are at Your expense and shall not engage the responsibility of On The Wild Side in the event of the Product being held in customs.


5.6. On receipt of the parcel, You must check the conformity of your order. Any anomaly concerning the references of the products delivered must be indicated on the receipt presented by the carrier and must be notified on the same day, or at the latest on the 1st working day following delivery, to On The Wild Side's customer service department ([email protected]).


5.7. In the event of deterioration of the Product during transport, You must inform the carrier within three working days, not including public holidays, following the date of delivery of the Products. Failure to lodge a claim within this period shall extinguish any action against the carrier in accordance with Article L.133-3 of the French Commercial Code. A copy of your letter must be sent to On The Wild Side without delay.


5.8. In case of delay beyond 30 days, On The Wild Side will contact you by email or telephone to determine with You the follow-up to be given to Your order. The order will only be cancelled upon express request from You addressed to On The Wild Side by registered letter with acknowledgement of receipt specifying the date and order number, the Products and the amount concerned.

ARTICLE 6 - RETRACTION / RETURN / EXCHANGE



6.1. On The Wild Side is committed to providing You with high quality products. Despite this, if You are not satisfied with Your order, You have a period of fourteen (14) days from receipt of the Products to exercise Your right of withdrawal. To do so, You must send your request for return or exchange by email to [email protected], indicating the number and date of the order, your full name, delivery address and the Products concerned. On The Wild Side will inform you of the procedure to follow, and you must prepare the package containing the Products and the invoice.


6.2. You must return the Products in their original condition (packaging) within fourteen (14) days of the agreement you will have received by email from On The Wild Side. On The Wild Side may refuse the return, refund or exchange of any product which has not been received within this period or which is incomplete, opened, damaged or whose original packaging has been damaged by you.


6.3. Any risk associated with the return of the Product(s) shall be borne by you.


6.4. Return shipping costs are at Your expense. On The Wild Side will not accept packages sent postage due.

ARTICLE 7 - WARRANTIES



7.1. In accordance with article L.217-4 et seq. of the French Consumer Code, On The Wild Side is required to deliver a Product that conforms to the order and to answer for any defects in conformity existing at the time of delivery. 

Within the meaning of Article L.217-5 of the French Consumer Code, the Product conforms to the contract:

2° or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the seller's attention and accepted by the latter. 

Article L.217-12 of the French Consumer Code stipulates that "any action resulting from a lack of conformity must be brought within two years of delivery of the product.

Any return of a Product shall be made under the same conditions as those set out in articles 6.2. and 6.3. of these terms and conditions.


7.4. At the end of the verifications made by On The Wild Side, if the non-conformity of the Product is confirmed, You will have the choice, in accordance with article L217-9 of the French Consumer Code, between repairing or replacing the Product. However, On The Wild Side reserves the right not to proceed according to Your choice if this choice entails a cost manifestly disproportionate to the other method, given the value of the Product or the importance of the defect.


If the hidden defect is proven, You may choose between rescission of the sale or a reduction in the purchase price in accordance with article 1644 of the French Civil Code.

ARTICLE 8 - INTELLECTUAL PROPERTY

ARTICLE 9 - FORCE MAJEURE



9.1. The performance by On The Wild Side of its obligations under this contract will be suspended in the event of Force Majeure for the duration of the Force Majeure, including in the event of disruption, flood, fire or strike of postal services and means of transport or communication. Accordingly, On The Wild Side shall not be liable for any direct or indirect damages arising from such events beyond its control.


9.2. When the suspension of the performance of On The Wild Side's obligations continues for a period exceeding ninety (90) days, You have the option to cancel the order in progress and On The Wild Side will then proceed with the reimbursement of the order.

3.1 It is your responsibility to check during the order process, item by item, that the number and price have been taken into account in the order form.


3.2. When a Product is no longer available, On The Wild Side will inform you by email of this unavailability and will propose modalities in accordance with the article "Delivery".


3.3 On The Wild Side reserves the right to refuse any order whose quantities would be abnormally high or if On The Wild Side met problems of payment with this consumer at the time of a preceding order.

ARTICLE 4 - PAYMENT



4.1. All orders must be paid in Euros on our secure transaction platforms PAYPAL or STRIPE. On The Wild Side will accept your online payment made with one of the following payment methods: Visa, MasterCard, American Express or Paypal. Your payment is encrypted and secured by STRIPE or Paypal. By communicating your credit card information, you authorize On The Wild Side to debit your credit card for the amount corresponding to the price of your order.


4.2. For a total amount exceeding 800 Euros, additional information may be requested.


4.3. You confirm that you are the holder of the debited bank card and that the name appearing on the bank card is indeed yours.


4.4. In the absence of payment of the full price of the order, On The Wild Side reserves the right to cancel the order without delay. It will be your responsibility to place a new order using a valid means of payment.


4.5. The Products remain the property of On The Wild Side until full payment has been received. 


4.6. You are solely responsible for any telecommunication costs incurred in accessing the Site.

ARTICLE 5 - DELIVERY



5.1 It is Your responsibility to ensure the accuracy of Your contact details when placing Your order: name, complete delivery/billing address, email address and telephone number. Delivery will be made to the delivery address indicated by You on the order form.


5.2 On The Wild Side delivers to all EU countries, the United Kingdom of Great Britain and Northern Ireland, Norway, Switzerland, the USA, Canada, South America, Russia, Japan, Singapore, South Korea, Taiwan and the Middle East. 

Delivery costs depend on the place and method of delivery chosen by You and are calculated on the total amount of the order. They will be indicated to You at the end of the order process before You confirm the order. 

After confirmation of the order and validation of the payment by On The Wild Side, the Products will be delivered according to the means chosen among those proposed during the ordering process.


5.3. We do our utmost to ensure that delivery takes place as quickly as possible, within 30 days at the latest. In the event of difficulties, we will keep You informed by e-mail. 

The delivery date is determined by the sum of the following elements: the successful receipt of your payment, the preparation of your order, the collection of the parcel(s) by the carrier and the delivery time of your parcel by the carrier according to the delivery method chosen by you on the Site.


5.4. When the parcel is dispatched, we send you the corresponding tracking number by email. You can track your parcel from the moment it leaves our premises until it arrives, by entering its tracking number on the carrier's website.


5.5. Customs duties and other taxes due in the country of arrival are at Your expense and shall not engage the responsibility of On The Wild Side in the event of the Product being held in customs.


5.6. On receipt of the parcel, You must check the conformity of your order. Any anomaly concerning the references of the products delivered must be indicated on the receipt presented by the carrier and must be notified on the same day, or at the latest on the 1st working day following delivery, to On The Wild Side's customer service department ([email protected]).


5.7. In the event of deterioration of the Product during transport, You must inform the carrier within three working days, not including public holidays, following the date of delivery of the Products. Failure to lodge a claim within this period shall extinguish any action against the carrier in accordance with Article L.133-3 of the French Commercial Code. A copy of your letter should be sent to On The Wild Side without delay.


5.8. In case of delay beyond 30 days, On The Wild Side will contact you by email or telephone to determine with You the follow-up to be given to Your order. The order will only be cancelled upon express request from You addressed to On The Wild Side by registered letter with acknowledgement of receipt specifying the date and order number, the Products and the amount concerned.

ARTICLE 6 - RETRACTION / RETURN / EXCHANGE



6.1. On The Wild Side is committed to providing You with high quality products. Despite this, if You are not satisfied with Your order, You have a period of fourteen (14) days from receipt of the Products to exercise Your right of withdrawal. To do so, You must send your request for return or exchange by email to [email protected], indicating the number and date of the order, your full name, delivery address and the Products concerned. On The Wild Side will inform you of the procedure to follow, and you must prepare the package containing the Products and the invoice.


6.2. You must return the Products in their original condition (packaging) within fourteen (14) days of the agreement you will have received by email from On The Wild Side. On The Wild Side may refuse the return, refund or exchange of any product which has not been received within this period or which is incomplete, opened, damaged or whose original packaging has been damaged by you.


6.3. All risks related to the return of the Product(s) are at Your expense.


6.4. Return shipping costs are at Your expense. On The Wild Side will not accept packages sent postage due.

ARTICLE 7 - WARRANTIES



7.1. In accordance with article L.217-4 et seq. of the French Consumer Code, On The Wild Side is required to deliver a Product that conforms to the order and to answer for any defects in conformity existing at the time of delivery.

Within the meaning of Article L.217-5 of the French Consumer Code, the Product conforms to the contract: 

1° whether it is fit for the use ordinarily expected of similar goods and, if so : 

- if it corresponds to the description given by On The Wild Side and has the qualities presented as a sample or model; 

- it has the qualities that a purchaser may legitimately expect in the light of public statements made by the seller, the producer or his representative, particularly in advertising or labelling; 

2° or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the seller's attention and accepted by the latter. 

Article L.217-12 of the French Consumer Code stipulates that "any action resulting from a lack of conformity must be brought within two years of delivery of the product.

7.2. In addition, under article 1641 of the French Civil Code, "the seller is liable for any hidden defects in the item sold which render it unfit for its intended use, or which diminish this use to such an extent that the buyer would not have purchased it, or would have paid a lower price for it, had he been aware of them".


7.3. If the Product(s) are non-conforming under the conditions set forth in article 7.1 hereof or if they present defects as defined in article 7.2 hereof, You must exercise these warranties by sending Your request to [email protected ] to notify the non-conformity or defects of the Product(s). On The Wild Side will acknowledge receipt of Your request and will inform You of the steps to be followed in this process.


Any return of a Product shall be made under the same conditions as those set out in articles 6.2. and 6.3. of these terms and conditions.


7.4. At the end of the verifications made by On The Wild Side, if the non-conformity of the Product is confirmed, You will have the choice, in accordance with article L217-9 of the French Consumer Code, between repairing or replacing the Product. However, On The Wild Side reserves the right not to proceed according to Your choice if this choice entails a cost manifestly disproportionate to the other method, given the value of the Product or the importance of the defect.


If the hidden defect is proven, You may choose between rescission of the sale or a reduction in the purchase price in accordance with article 1644 of the French Civil Code.

ARTICLE 8 - INTELLECTUAL PROPERTY



In general, trademarks, whether figurative or not, and more generally all logos, images, symbols and illustrations appearing on the Site and/or on the Products and their packaging, whether registered or not, (hereinafter, the "Intellectual Property Rights") are and shall remain the exclusive property of On The Wild Side. 


Any reproduction, copy, distribution, modification or use, in whole or in part, of these Intellectual Property Rights, for any reason and on any medium whatsoever, without the express prior consent of On The Wild Side, is strictly prohibited. 


The same applies to any combination or conjunction with any other trademark, symbol, logotype or, more generally, any distinctive sign intended to form a composite logo. The same applies to all copyrights, designs, models and patents which are the property of On The Wild Side or for which On The Wild Side holds the rights.

ARTICLE 9 - FORCE MAJEURE



9.1. The performance by On The Wild Side of its obligations under this contract will be suspended in the event of Force Majeure for the duration of the Force Majeure, including in the event of disruption, flood, fire or strike of postal services and means of transport or communication. Accordingly, On The Wild Side shall not be liable for any direct or indirect damages arising from such events beyond its control.


9.2. When the suspension of the performance of On The Wild Side's obligations continues for a period exceeding ninety (90) days, You have the option to cancel the order in progress and On The Wild Side will then proceed with the reimbursement of the order.

ARTICLE 10 - APPLICABLE LAW / DISPUTES



10.1. This contract is written in French and governed by French law.

On The Wild Side undertakes not to divulge to third parties any personal data that you may communicate to us. Your personal data will only be used by our internal services to process your order, reinforce and personalize communication and offers relating to the Products reserved for On The Wild Side customers, in particular through the Site's newsletters to which you have subscribed.
